1. Acceptance
By accessing or using NestGuess (the "Service", at nestguess.com) you agree to these Terms of Service. If you don't agree, don't use the Service.
2. About NestGuess
NestGuess is a browser-based game where players guess the asking price of US residential real-estate listings. Listing photos, prices, and addresses are sourced from publicly-available third-party data and are shown for entertainment. NestGuess is not a real-estate service and does not facilitate transactions.
3. Eligibility
You must be at least 13 years old to use the Service. If you're under the age of majority in your jurisdiction, a parent or legal guardian must agree to these Terms on your behalf.
4. Your account
You can play as a guest without creating an account. To keep your XP, streak, and leaderboard standing you may sign up with an email and password or through a third-party identity provider (Google).
You're responsible for keeping your password secure and for any activity that happens under your account. Notify us at info@nestguess.com if you suspect unauthorized access.
5. Acceptable use
Don't use the Service to:
- Cheat, script, or use automated tools to inflate your score or streak.
- Impersonate another person, upload offensive or illegal avatars, or choose an offensive display name.
- Attempt to disrupt, probe, or reverse-engineer the Service, its APIs, or its underlying infrastructure.
- Scrape, resell, or redistribute listings or any other content obtained from the Service.
- Violate any applicable law or the rights of others.
6. Content you provide
You retain ownership of the name and avatar you upload. By uploading them you grant NestGuess a worldwide, royalty-free, non-exclusive license to display them within the Service (for example on leaderboards, in multiplayer lobbies, on your public profile). You can revoke this by removing the content or deleting your account.
7. Third-party content and services
Property photos, prices, and geographic data are provided by third-party sources (including but not limited to Zillow and MLS data providers). Accuracy is not guaranteed. We may cache, resize, or reformat this content solely to display it within the Service.
The Service relies on third-party providers (hosting, database, email, authentication, analytics). Your use of the Service is also subject to those providers' terms; see our Privacy Policy for the current list.
8. Termination
You can stop using the Service at any time. To delete your account and associated data, email
info@nestguess.com. We may suspend or terminate accounts that violate these Terms, at our sole discretion, with or without notice.
9. Disclaimer
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We don't warrant that the Service will be uninterrupted, error-free, or that any information (including listing prices) is accurate or current. Nothing in the Service is real-estate advice or a solicitation to buy, sell, or lease property.
10. Limitation of liability
To the maximum extent permitted by law, NestGuess and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. In no event will our aggregate liability exceed the greater of USD $50 or the amount you paid us in the 12 months preceding the claim (currently $0 — the Service is free).
11. Changes
We may update these Terms from time to time. If changes are material, we'll update the effective date at the top of this page and highlight the change on the Service. Continued use after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.
